Auction Terms and Conditions

These Auction Terms and Conditions ("Terms") govern all bidding, sales, and participation in any auction hosted Levi’s World via www.levisworld.com.au or any other designated platform ("Auction Platform"). By participating, you agree to be bound by these Terms and our Contract of Sale, which is incorporated herein by reference.

1. Bidders and Eligibility

1.1 Entry is open only to individuals aged 18 years or older and residents of Australia.
1.2 By placing a bid, you warrant that all information you provide is true and accurate.
1.3 We reserve the right to deny or revoke access to any participant at our sole discretion without notice.

2. Auction Process

2.1 All auctions are conducted online and conclude at the designated end time unless extended due to anti-sniping mechanisms.
2.2 Bids are final and binding. No bids may be withdrawn or modified once submitted.
2.3 The highest bid at the close of auction will be deemed the winner. We reserve the right to reject any bid or bidder without explanation.

3. Payment and Completion

3.1 The winning bidder must complete payment within 48 hours of the auction ending using one of our approved payment methods.
3.2 Failure to pay constitutes a breach of contract. We reserve the right to cancel the sale, offer the item to the next highest bidder, or re-auction the item.
3.3 Upon payment, a legally binding contract of sale is formed under our full Contract of Sale.

4. No Refunds or Returns

4.1 All auction sales are final. No refunds or returns will be accepted for change of mind, bidder error, misreading descriptions, or buyer’s remorse.
4.2 To the extent permitted by law, we exclude liability for minor defects, packaging discrepancies, or cosmetic variations.
4.3 You acknowledge and accept that items may be pre-owned, pre-release, rare, or collector’s items with variable condition unless explicitly stated otherwise.

5. Description and Condition

5.1 All reasonable efforts are made to describe auction items accurately, but no guarantees are made regarding completeness, authenticity, or suitability unless expressly stated.
5.2 Images are for reference only. Actual items may vary slightly.
5.3 It is your responsibility to conduct your own due diligence before bidding.

6. Limitation of Liability

6.1 To the fullest extent permitted by law, our total liability for any claim arising from the auction shall not exceed the amount paid for the relevant item.
6.2 We are not liable for:

• Delays or losses caused by third-party carriers or payment processors
• Interruptions, technical failures, or platform errors
• Any indirect, incidental, or consequential loss

7. Chargebacks and Disputes

7.1 By participating, you waive all rights to dispute the transaction through your payment provider except in cases of proven fraud or unauthorised use.
7.2 Unjustified chargebacks constitute a breach of contract and may incur administrative and legal fees.
7.3 All disputes must follow our internal complaints process prior to any external escalation.

8. Ownership and Risk

8.1 Title passes to the buyer upon receipt of full payment. Risk passes at the point of dispatch.
8.2 We are not liable for any damage, loss, or theft occurring after shipment.

9. Fraud and Misconduct

9.1 Any attempts to manipulate bidding, including collusion, shill bidding, or technical interference, will result in disqualification and legal action.
9.2 We reserve the right to refer cases to law enforcement or pursue damages where fraud or malicious conduct is suspected.

10. Governing Law and Jurisdiction

10.1 These Terms are governed by the laws of Victoria, Australia.
10.2 Any dispute arising from these Terms must be resolved exclusively in the courts of Victoria.

11. Updates and Amendments

11.1 We may amend these Terms at any time without notice. Participation in an auction after such amendments constitutes acceptance of the revised Terms.
